Hi xdjm,

I have some questions about our tax status. My ld came to us in the January, 2003 and I came to in the July,2003.

1) Can he file as a resident? Can I file as a resident also?

2) My income is higher than my ld. Will it help if I claim my kid as my dependent?

3) My ld was studying at state A, and worked for a company at state B, and also worked this company's sub office at state C. How can we file the state tax?

Thanks so much for your answer!!!!

it really depends on your state regulation.

in some states, no matter how many years the F1 students have been studying there, their tax status is considered non-resident.
