tax filing status question. NEED HELP

the year.He changed from F-1 to H-1 in October and bought a new car & laptop
last year. Filing jointly might save more money than seperately in common
sense but if we do that, since i am resident alien, jointly will take away his
non-resident status for the whole year, then he cannot use the $5000 treaty
deduction for student. So, which way is better for us to do it?

$5000 is still valid for him to claim no matter he is resident or NR, as long as he is in the student status. this is stated in US-China 20(c).

that sounds our prob is solved. we can just file jointly and use his $5000 as well.
if we use 1040 form, where do you put that $5000? and where should that $3200 (general deduction for each person) go?
for using OPT, what form do you get? W-2 or 1099-misc? an accontant told us that if we have 1099-misc then we will pay more taxes because that form means you are self-imployeed or under contract which is at a higher tax rate. he got 1099-misc for his OPT period. is that something wrong?
