If you are applying Eb1 outstanding researcher, you MUST your employer (NIH) agreement. Your supervise cannot just sign the papers. USCIS might not recognize it.Trust me.

I would suggest you apply NIW (National Interest Waiver). If your case/background is strong enough, it won't be difficult for you to get approval cause you are working for NIH.
