I am not sure what the filing status you put in for your tax return.  Please not that if you are a nonresident alien, you can claim the EIC only if you are married to a United States citizen or resident, and you file a joint return and are taxed as a resident for the entire taxable year.  Look at this link for details: http://www.irs.gov/taxtopics/tc601.html
