1。老公2007 一年 H1 + 我 F1:老公可以按照resident 报税,我不够5年,根据一妮给的链接,我们可以联合报税,对吗?

you might file jointly with your husband. it is a special treatment for non-resident spouse to file as resident for tax purpose. and you should be able to still have treaty benefits as long as you hold f1.

2。因为我们在不同的州,州税肯定是要分开的,我隐约记得州税好像和联邦税的某些数字有关,如果和老公连起来报联邦税,我的收入肯定要比自己的多,本来没交多少州税,难道还要补交州税吗?又觉得不合理,因为老公是在另一个州挣的钱。也不知道自己说清楚了没有?

I understand your questions very well.

in most states, the state income tax form starts with federal agi ( adjusted gross income).State income tax system varies from state to state. For instance, some states allow you to file " married file seperately" even you file your federal income tax jointly. Some states strictly require a consistent filing statis with federal income tax ( they have system to compare state income tax form and federal income tax form).

With no detailed knowledge of the tax system of the states that you and your husband reside, I am afaid that I might not be able to provide any further assistance.

sixer, I guess it depends on the difference between your incomes.

if your incomes have big differences, you might save you some if you file jointly. if your incomes are similar, no big different at federal level.

if you are nonresident filed as resident, I think you should be able to get the rebate.

however, this is a one-time shot and nobody has a reality check yet, I guess it is just a personal opinion.
